for use. These terms and conditions apply to the use of this Website and by
accessing this Website and/or placing an advertisement you agree to be bound by
the terms and conditions set out below. If you do not agree to be bound by
these terms and conditions you may not use or access this Website.

Definitions
"Conditions" means these terms and conditions;
"Advertisement" means an entry, which
includes both a CV and the associated skills and descriptions placed on the
Website;
"Users" means the users of the Website
collectively;
"Customer" means Recruiter or Job seeker
who places information or advertisements on this web site;
"Personal Information" means the details
provided by you on registration;
"We/us" means cvmoon;
"Website" means the website located at
www.cvmoon.com or any subsequent URL which may replace it;
“Service(s)” means the functions and facilities
provided by the cvmoon Website.
"
"You" means a user of this Website.
Use of the
website
Access -
You are provided with access to this Website in accordance with
these Conditions and any use of this Website must be strictly in accordance
with these Conditions. You have the right to access all
personal information supplied to cvmoon, and rectify any inaccuracies on the
information held. All personal information stored by cvmoon is accessible from
your account screen.
Privacy policy -
We will treat all your
Personal Information as confidential. We will keep it on a secure server and we
will fully comply with all applicable UK Data Protection and consumer
legislation in place. All
personal information collected and used from the cvmoon site will be processed
in accordance with the 1998 Data Protection Act.
In accordance with the requirements
of the 1998 Data Protection Act - we have taken measures to ensure that
information supplied to us is held securely. As a consequence we will request
proof of identity via Username and Password before allowing access to your
personal information. It is your responsibility to keep your password secure

Indemnity -

indemnify, defend and hold us, and our officers, directors, employees, agents
and suppliers, harmless immediately on demand, from and against all claims,

fees, arising out of any breach of the Conditions by you or any other

Acceptable Use Policies -

advertisements or CVs. You must assume the risk of accessing content through
the Service, and neither we nor any of our employees, shall have any liability
for any claims, losses, actions, damages, suits or proceedings arising out of
or otherwise relating to access to such content.
You are solely responsible for any information that you publish in your
advertisement or CV. We and our employees reserve the right to refuse to post
or to remove any information or materials, in whole or in part, that it, in its
sole discretion, deems to be offensive, indecent, or otherwise inappropriate
regardless of whether such material or its dissemination is unlawful.
Legal obligations
We and our employees have no obligation to monitor transmissions made on the
Service(s). However, we and our employees have the right to monitor such
transmissions from time to time and to disclose the same in accordance with
your agreement.
By using the Service(s) to reproduce, publish, display, transmit and distribute
content, you are warranting that the content complies with this Policy and you
are authorising us and our employees to reproduce, publish, display, transmit
and distribute such content as necessary for us to deliver the content in a
timely manner when required through legal processes.
If you do not abide by the limitations of the service(s), you will have action
taken against you, not limited to, but including instant termination of your
account.
Any decision made by us in relation to this service shall be final.
Email and
Viruses
Attachments to email messages may contain viruses that may damage your system. Whilst the cvmoon.com has taken every reasonable precaution to minimise this risk, we cannot accept any liability for any damage, which you sustain as a result of these factors. You are advised to carry out your own virus checks before opening any attachment.
Use
of Candidates CV’s and the cvmoon Message Forwarding Facility:
These facilities must only be used to find and make
contact with a matching candidate for a genuine and current vacancy, you may
not use this facility to contact candidates for any other purpose such as but
not limited to, sending of spam email, “phishing” for CVs or other candidate
information, malicious or fraudulent intent.
We
accept no responsibility for loss of data, information in any form or other
matters whatsoever which result from the use of this Service.
You may not send any adult material, material liable to offend, defamatory,
confidential, secret or other proprietary material using the message forwarding
service. You will be held responsible for and accept responsibility for any
material of this nature available via this Service. We accept no responsibility
for material of this nature available via this Service.
We shall not be held liable for any loss of material however occasioned.
Access to Candidate CV’s and the cvmoon Message Forwarding Facility will not be possible
if your account is, for any reason, suspended.
If so requested by us, or a recipient of your forwarded message, you must
desist from posting messages to said recipient on request.
Any decision made by us in relation to this service shall be final.
We
reserve the right to refuse a request for a recruiter account or to remove an
existing recruiter account at any time.
Placing
of Job advertisements (Including both free and Paid for job adverts):
Responsibility for the contents of job advertisements
submitted to cvmoon.com rests solely with the Advertiser. In displaying any
such advertisement cvmoon.com does not accept any responsibility for ensuring
that material submitted is compliant with all applicable laws and regulations.
No liability will be accepted by cvmoon.com in
connection with any web site controlled by a third party that may be accessed
from this web site.
cvmoon.com does not endorse or authorise the contents of
any such site.
Any material downloaded or otherwise accessed through the
use of this web site is obtained entirely at the user's own risk and that the
user will be entirely responsible for any resulting damage to software or
computer systems and/or any resulting loss of data even if cvmoon.com has been
advised of the possibility of such damage.
By placing Job advert(s) on the cvmoon.com web site and
by providing email address(es) and web site address(es) you acknowledge that
this information will be publicly available and may be subject to misuse by
malicious or fraudulent thirds parties which cvmoon.com has no control over
and accepts no liability for such use of.
cvmoon.com reserves the right to edit or remove any job
advert without notification that we deem unfit or inappropriate for this web
site.
cvmoon.com disclaims all warranties (express and
implied), representations or assurances of any kind relating to the accuracy,
content or fitness for any purpose of the information that appears on the web

Job Seeker
- Placing an Advert
Introduction:
By submitting an
advertisement to the cvmoon web site, you are deemed to have accepted the terms
and conditions laid out here. These terms and conditions and the contract of
which they form part shall be governed by English law. All references to
"Job Seeker or Candidate" refer to the user applying to place an
advertisement of their CV and related skills on cvmoon. All references to
"the web site" refer to the cvmoon.com Internet site. All references
to "us" refer to cvmoon. This service offers the facility to compose
and place an advertisement of your availability for work in the
We strongly
recommend you not to include your e-mail address or other contact information
in either your advertisement or CV.
If you do provide
this information it will be in the public domain and could be used by third
parties for canvassing or for fraudulent means.
When will my CV
advert appear?
Advertisements will
be published on the site immediately after successful validation of your
information has been performed by the cvmoon team. Validation of Candidate
adverts usually occurs within 24 hours of request.
Duration of
placement:
Advertisers are
offered the option of placing an advertisement for a period of 90 days from the
date of first publication on the web site. At any time the advertisement can be
extended for a period of 90 days from today’s date.
Processing your
advert:
Only one person
(candidate) may be featured in each advertisement.
The contents of your
advert including the CV you supply, must be legal, decent, honest and truthful
and must comply with the British code of Advertising. cvmoon may amend the
advertisement to ensure compliance with these requirements. cvmoon is not able
to verify the truthfulness of any statements or claims made by a customer in
the advertisement copy. Accordingly, the customer shall be responsible for any
losses, expenses or other costs incurred by cvmoon caused by an untrue statement
or inaccurate information supplied by the customer.
In the event that cvmoon
is unable to accept an advertisement for any reason, we will attempt to
inform the customer of this if at all possible. No contract will be deemed to
exist between the customer and cvmoon until the advertisement has been accepted
for publication on the web site.
The copyright in all
adverts shall be owned by us and you hereby assign all such copyright to us.
Advertisements
can be stopped by either deleting your account (button on your account screen
on the Website) or can be temporarily suspended (button on your account screen
on the Website). Once your account has been deleted your advertisement will be
permanently removed.
How and when your advertisement
will be confirmed:
As soon as an
advertisement has been accepted for publication, a confirmation email will be
sent to the advertiser explaining that the advertisement has gone live on the
site.
In the event that an
advertisement has been rejected for publication, cvmoon will send an email to
the customer explaining why their advertisement has been rejected.
How you can change
and delete your advert once live:
Once your advert has been accepted onto
the website, a confirmation email will be sent to you with details on how to
amend your advert once it's live on the site. All modifications to your
advertisement including the uploading of updated CVs can be achieved from your
account screen on the Website.
Note – Any
changes to your skills, job preferences and or CV must be re-approved by the cvmoon
team and your advertisement will not be active until you have requested and
been granted approval for your updates.
Recruiters - Placing a
Premium, Paid for Job advertisement
When will my Job
advertisement appear?
Job Advertisements
will be published on the site immediately after successful payment has been
completed.
Duration of
placement:
Advertisers are
offered the option of placing an advertisement for a period of 30 days from the
date of first publication on the web site.
Price:
The price of a job
advertisement on cvmoon is detailed on the “create Job Advertisement” page of
the web site.
Processing your
advert:
The contents of your
Job advert must be legal, decent, honest and truthful and must comply with the
British code of Advertising. cvmoon may amend the advertisement to ensure
compliance with these requirements. cvmoon is not able to verify the truthfulness
of any statements or claims made by a customer in the advertisement copy.
Accordingly, the customer shall be responsible for any losses, expenses or
other costs incurred by cvmoon caused by an untrue statement or inaccurate
information supplied by the customer.
In the event that cvmoon
is unable to accept an advertisement for any reason, we will attempt to
inform the customer of this if at all possible. In the event that we reject the
advertisement, the customer will incur no charge. No contract will be deemed to
exist between the customer and cvmoon until the advertisement has been accepted
for publication on the web site.

Payment is via

A full refund can only
be obtained if the advert has not gone live on the cvmoon website. Adverts are
processed instantly once successful payment has been completed. Adverts
cancellations made after the advert has gone live on the website will not be
eligible for any refund.
However,
the publication of an advert can be stopped to avoid unwanted responses.
Advertisements can be stopped by either deleting the Job advertisement or by
modifying it in such a way as to advertise a different job, in which case the
advertisement will run for any remainder of the initial 30-day period. Once a
Job Advert has been deleted your advertisement will be permanently removed and
no credit, monetary or other, will be given for any time left to run on your
advertisement.
How and when your
order will be confirmed:
As soon as an
advertisement has been accepted for publication, a confirmation email will be
sent to the advertiser explaining that the advertisement has gone live on the
site.
In the event that an
advertisement has been rejected for publication, cvmoon will send an email to
the customer explaining whom they need to contact in order to find out why
their advertisement has been rejected.
How you can change
and delete your advert once live:
Once your advert has been accepted onto
the website, a confirmation email will be sent to you with details on how to
amend your advert once it's live on the site. All modifications to your job advertisement
can be achieved from your account screen on the Website.
Liability:
cvmoon will need to
carry out routine maintenance and service of 'its' servers and equipment. While
cvmoon seeks to keep disruption to a minimum, it does not guarantee that the
advertisement will be continuously available on-line for the duration of the
advert.
English law shall
govern the terms and conditions of this contract of which they form a part.
All
details supplied to cvmoon with your on-line advertisement will be safeguarded
both by our privacy policy and also by the 1998 Data Protection Act.
General
Intellectual property
and right to use -
You acknowledge and agree
that all copyright, trademarks and all other intellectual property rights in
all material or content supplied as part of the Website shall remain at all
times vested in us or our licensors. You are permitted to use this material
only as expressly authorised by us or our licensors.
You acknowledge and agree
that the material and content contained within the Website is made available
for your personal non-commercial use only and that you may (if necessary to
make a Purchase) download such material and content onto only one computer hard
drive for such purpose. Any other use of the material and content of the
Website is strictly prohibited. You agree not to (and agree not to assist or
facilitate any third party to) copy, reproduce, transmit, publish, display,
distribute, commercially exploit or create derivative works of such material
and content.
Compliance
with laws -
The Website may be used only
for lawful purposes and in a lawful manner. You agree to comply with all applicable
laws, statutes and regulations regarding the Website and any transactions

not affect the validity and enforceability of any of the remaining provisions

Waiver -

construed as a waiver of any proceeding or succeeding breach of any provision.
Survival -
Each provision of the Conditions
shall be construed as separately applying and surviving even if for any reason
one or other of those provisions is held to be inapplicable or unenforceable in

Entire
agreement -
These Conditions govern our
relationship with you. Any changes to these Conditions must be in writing and
signed by both parties. In this way, we can avoid any problems surrounding what

You confirm that, in
agreeing to accept the Conditions, you have not relied on any representation
save insofar as the same has expressly been made a term of these Conditions and
you agree that you shall have no remedy in respect of any representation. Your
Statutory Rights are not affected by these terms and conditions.
Nothing in this Clause shall
limit or exclude our liability in respect of any fraudulent or negligent
misrepresentation whether or not such has become a term of the Conditions.

The Conditions shall be
governed by and construed in accordance with the laws of
